Applications Based on Long Residence

UK Immigration policy recognises that a person with regular or irregular immigration status can form some ties with the UK over a lengthy residence here.

You can be granted Indefinite Leave to Remain in the UK if you have been in the UK for continuous 10 years lawfully, you are of good character and you can meet English language and Life in the UK requirements.

There are 4 situations in which you might be eligible to apply for leave to remain on the basis of your private life in the UK:

  1. You have lived in the UK for 20 years continuously. This replaced 14 years continuous residence in the UK policy since 9 July 2012.
  2. You are a child under 18 years old who has lived in the UK for continuous 7 years and it would be unreasonable to expect you to leave the UK.
  3. You are 18 years old or over, but under 25 and you have spent half of your life in the UK.
  4. You are 18 years old or over and although you have lived in the UK less than 20 years continuously, but there would be very significant obstacles for you to integrate into the country you would have to go if required to leave the UK.

All the applications based on private life are usually quite complex and requires specialist knowledge. Evidence is a key factor for successful applications under the private life policy. In light of the above it is highly recommended to contact the immigration specialist for an advice before proceeding with the application based on private life in the UK.
